Primarily aimed at undergraduate law students, you’ll experience legal studies with both a basis in English law and legal methods, and a focus on international perspectives and issues. In addition to the seminars, lectures and group work on campus, you’ll also spend two nights in London, exploring and experiencing law in one of the global hubs of international commercial law.
Week 1 Formation of Business:
This topic introduces international commercial law by highlighting the concept of riskin business/commercial activities, providing a brief history of commercial law, discussing various business vehicles as well as the concepts and implications of separate legal personality and limited liability.
Week 2 Management of Business:
Exploring key issues in the trading phase of a commercial enterprise, you’ll consider the importance of finance/capital to commercial activities and how that finance is procured, discussing key concepts like security, guarantees, retention of tile and receivables financing. Finally, you’ll consider options for resolving international commercial disputes, with the focus on globally-used measures of arbitration.
Week 3 Insolvency and Commercial Transactions:
You’ll explore the notion of insolvency as a pervasive issue in international commercial law. It will highlight the impact of insolvency on commercial activity as well as the twin ideals of insolvency regimes to facilitate the restructuring/rescue of an insolvent entity or to procure a sensible distribution of available assets to creditors. Finally, the future of insolvency and other commercial law regimes in light of Brexit will be considered.
Students who complete this course are awarded 15 LU / 4 US / 8 ECTS credits.
This summer school will be assessed through two methods:
+ 75%: Essay (2,000 words)
+ 25%: Presentations, which will be delivered across the three weeks on specific themes
